Conflict Resolution: Ombudsman, Mediation & Ethics Complaints
Disputes can sometimes arise during a real estate transaction, often due to misunderstandings or breakdowns in communication. The Dutchess Association of REALTORS® offers several options to help parties resolve concerns in a fair, respectful, and professional manner.
Informal Resolution Options
If you wish to attempt to resolve an issue quickly and informally, you may choose one or both of the following options:
1) Ombudsman Program
A trained Ombudsman will listen to the concerns of all parties, provide impartial information, and help facilitate communication through a neutral third party. The Ombudsman does not determine fault or impose discipline, but works to promote understanding and resolution before a dispute escalates.
2) Mediation
Mediation brings both parties together with a trained mediator. The goal is to encourage open, face-to-face communication and assist the parties in reaching a mutually acceptable resolution. Participation is voluntary, confidential, and non-binding.
Formal Ethics Complaints
If an issue cannot be resolved through informal means, individuals may choose to file a formal ethics complaint. REALTORS® are required to abide by the REALTOR® Code of Ethics, which establishes high standards of professionalism, integrity, and accountability in real estate practice.
Formal ethics complaints are reviewed through DCAR’s Professional Standards process, which follows established procedures to ensure fairness, confidentiality, and due process for all parties involved.
Please note: The Ombudsman Program and mediation are voluntary dispute resolution options. Parties are not required to participate in Ombudsman services or mediation prior to filing a formal ethics complaint. A complainant may proceed directly with a formal ethics complaint at their discretion.
